Welches Container Explosion

What is the name of your state (only U.S. law)? New York

I purchased a container of Welches and about a week after words it exploded and sprayed everything in my room and damaged the walls and ceiling as well as computer damage and damage to clothes. The container had been open and drunk about a third of the way. The bottle was not refrigerated (because my refrigerator was not in operation). The grape juice fermented and while I was sleeping exploded and sprayed my entire room. Can I hold welches liable for the damages based on their defective product design which lead to the explosion?

Why is this Welches problem and not yours??? Who said their product was defective? It appears to me that the fact you did not refrigerate the product is the reason the juice 'sploded.

Of course you can't. It says right on the side of the bottle to refrigerate it after opening it. I just checked the bottle in my fridge to verify that.

It says this specifically because grape juice ferments, which releases gas, causing the sealed bottle to explode.

This is your fault.

Welch's is not responsible for your trash exploding :rolleyes:

A milk gallon can absolutely explode from fermenting.

Whether you believe it is Welch's fault or not is not relevant. You can certainly sue. You have precisely zero chance of winning.

Under the right conditions, it sure can. You need to accept the responsibility for not following the directions on the bottle.

Do you really think that juice manufactures need to sell juice in a pressure vessel because, if handled improperly by someone who ignores the directions as well as basic 5th grade science, the container may burst.

Like the other posters, I have to wonder what on EARTH makes you think that Welch's should be responsible for YOUR error in following directions?

I understand you lawyer types' job is to tell people what they don't want to hear but there's no need to be rude about it and troll me.

I have just one question:
Shouldn't the container be able to hold its contents? It doesn't need to be in an aluminum pressurized container but it should be able to prevent its contents from exploding, no?
