Greg,
Assuming your attorney is competent, he'll do discovery out the yazoo on the company.
First question I'd have is "Where's the paper trail?" that proves that you actually have any ownership interest since you claim you didn't get any stock certificates.
Next, I must say that your...
Actually, it may be possible to tak ethe 341meeting to the petitioner. For instance, the trustee can go to the hospital or wherever. No one SAYS it has to be at a courthouse.
I've seen 341 meetings held at a recplex for gosh sakes.
The key is to CONTACT the TRUSTEE WELL AHEAD of time to make...
If the rent is not due, sounds like the landlord is attempting to frontload the BK.
I had this happen as a tenant of a commercial building. Landlord went BK, sent letters demanding rent and two days later the trustee sent letters demanding rent and both claiming priority and threatening legal...
First, was this debt listed as a secured debt?
Next what exactly do they think they are trying to recover? A claim on secured property post-BK is very possible, but the creditor should know what they are claiming.
It is possible. The law prevents you from being terminated because of a bankruptcy BUT it does not prevent the security clearance from being revoked. And if your job is requires the revoked clearance, then your position can be terminated then.
Security clearances are not automatically revoked...
If I could inject a bit of "whoa up there", please note that we have ALOT of beliefs posted as facts by Nick.
During the bankruptcy and prior to the creditor meeting, my spouse purchased a mobile home for $6,500.00 in September 2004. She gave the money to her sister to purchase the mobile home...
"Rejected by Trustee"....while possible, the trustee will have some exceptional reasons for it. Either this trustee is WAY off the reservation or something is seriously wrong with your filing.
As a guess, either you're not telling us something or your attorney has messed up the filing.
For...
The main reason for listing everyone is in case you "miss" someone.
True example:
Client was convinced they had paid a bill and didn't want to list it. They even had check numbers, which had cleared.
Great. I told them to check anyway.
Lo and behold, the creditor claimed never to have gotten...
Jack,
Before you start throwing around charges of fraud, make sure you're NOT on the creditors matrix.
You may be on there with a different address, or you may have missed the notice.
If indeed you are on the matrix with a correct or even incorrect address and you claim fraud, the court will...
For credit card companies:
1) List billing question address (usually on back)
2)Also to Payment address
3) And to any other address you see
List the amount owed only once. On subsequent entries, list as "Alternate address", "Duplicate Claim", "0.00" as debt.
Like this:
acct number 456...
>>>I gotta ask . What did he say after you explained it to him?>>
He didn't say a thing..... he just kinda wandered off....which is what an attorney should do when they are in over their head. Shut up and go do some research.
I just wonder what kind of courses he took in lawyering school.....
What is the name of your state? MO
At the courthouse yesterday with two friends about to go to lunch. One of the friends (defendant attorney) was explaining to a Citiscum attorney (plaintiff attorney) that the just-continued lawsuit they were litigating was pretty much moot, since the defendant...
Here's how I'd handle this (MY OPINION ONLY)
1) Back up your data
2) Consolidate to the fewest hard drives possible.
3) Get ready to pull those hard drives and claim them as personal property if necessary.
4) Software Licenses-Most EULAs say that you CANNOT transfer the license and to do so...
