    North Carolina Hearing Procedures

What is the name of your state (only U.S. law)? North Carolina (I am from PA) My daughter, a student in North Carolina, recently totaled her car (actually my 2003 Impala LS). She swerved to miss a deer that was in her lane and unfortunately managed to go into a deep ditch on the other side of...

    help with a speeding ticket!

Although this is just so much fun there is no point in wasting any more of my time, since blasting people who request help is just that. The only thing I have left to say is that I am headed to court for my 3rd ticket in the past 1-1/2 years and the first 2 resulted in dismissals and both were...

    help with a speeding ticket!

This is totally incorrect. The unit doesn't have to malfunction at the time the speed is read because this would be difficult to prove (although there have been cases where radar was proven to have the potential to operate incorrectly under certain conditions and tickets have been dismissed)...

If the officer wrote 3662, then you might have a chance.

The push for radar use by local cops is pretty hard and I expect it to happen before long. The current version includes a provision that only a certain percentage of a municipality's revenue can come from the radar (can't recall the % this second). I just received my hearing notice a couple...

    Speeding

Although it appears people have gotten off due to mistakes on the ticket, I would believe that a 2 that looks like a 7...well that probably doesn't cross the threshhold. BTW: Where did you get ticket in PA?

A lawyer that is familiar with PA laws especially where you got the ticket may be a worthwhile investment. When I got my first ticket (not the first in my life, but first in 14 years or so) I had little choice but to fight. I was doing 97 in 65 and that can mean license suspension in PA. I...

    Wrong posted speed on ticket

That may be the way it is supposed to go but if you are under the impression that all judges follow decorum and all police officers tell the truth, I would have to say that you are somewhat naive. However, the question has and is presented if the judge has the desire to. This is especially...

    Speeding 60/40 contest or not?

My State: PA I was going through some back messages and found this one, so I don't know if you dealt with this but I must respond to take exception to a reply by racer72 I would beg to differ with this. It is up to the state to prove you were speeding. Which means the evidence must have a...

    Wrong posted speed on ticket

I was not referring to a guilty plea. Everything I was talking about had to deal with a "not guilty" plea.

    Wrong posted speed on ticket

My state: PA Although I am not from Texas, I would think some things in front of a judge are similar. First off if you go in front of the judge, refrain from making excuses or testifying at all. It is pretty much a waste of time. Use technical perspectives. After the officer has testified...

Yes I did have to go to court as you must if you plead not guilty. Just as the officer must be there. If he (or she) doesn't show and you do, you can get a dismissal (you must request it in a proper fashion). I don't have my records in front of me to look at the hearing notice, but if you...
