    No, I am not trying to compare them. I am applying the logic that justifies the insurance premium discount to a settlement. The discount on the premium is given because it saves the insurance company money. Well, my wearing all my motorcycle gear does the same. Why not get the benefit?

    True. Also true. However, I did get a discount ($$$) on my insurance for having a theft recovery device on my bike. And my bike hadn't been stolen, yet.

    There IS a thing called right of way, and the person in the lane ALWAYS has right of way vs the person trying to merge. You're required to make a safe lane change.

    Always take pictures of your damage, their damage, their license plate, them, any broken pieces of car on the ground (the accident site) and just ask for their insurance. Since you've already got their car model and license plate you can file a claim with your insurance if they refuse.
