CA "re-aged" my debt to Original Creditor on my Credit Report

What is the name of your state? Texas The CA (Credigy, who bought my debt from First Select, who had bought my debt from Discover) re-aged my debt to Discover card by putting a "date open 12/1/2002" with Credigy on my credit report. I never made any written agreement with Credigy. Nor did I...

    Legal Counsel

I'm no expert but... ...I've been reading a lot about these things the past couple of days as I have been sued by a CA. First of all I'd say there is no judgment against you unless you've been sued -- and you would know it if you were sued unless you have been dodging your mail, etc. But what...

SOL for credit card debt exceeded in TX?

Okay. I checked, and they're right -- the account began in 9/2000. It must have (had to be) a deal where they opened the account with me in a deal where I moved my debt from another card over to them. I know that something like that happened that year. It seemed like all the credit card...

SOL for credit card debt exceeded in TX?

Thanks you guys! Well, my only "proof" of when the last payment was made is that I could show copies from a year or more worth of bank statements and every single month would show a payment to the Creditor until March 2001. Then I could show as many statements as they want beyond March 2001 to...

SOL for credit card debt exceeded in TX?

Okay will check that out Thanks for the pointers. I'll look into that site some more. So much to do and so little time! But is there any way to find out FOR SURE that they're outside the SOL? Because I have run across postings with talk of the SOL being the X number of years plus...

SOL for credit card debt exceeded in TX?

Sounds like i need to find out EXACT extension of SOL Thanks, Guy. I'll try those links to see if I can find out anything on whether or not I have a prayer. It sounds like everything is going to be riding on the laws of the State of Texas in re the SOL and what is exactly to considered to be...

    What can they do?

I think my limit with them was $10,000. The other $9,000-plus is, I think from interest. Or maybe some was from consolidating a loan. I can't even remember anymore. Going bankrupt is officially harder to do now. I hear Bush signed it into law yesterday. But still it is not an option for me...

SOL for credit card debt exceeded in TX?

What is the name of your state? Texas My last payment was 2/12/2001. I received an original petition suing me for this credit card debt on 4/26/2005. Best I can tell, this means it has been 4 years and 72 days since the last payment. Am I eligible to cite SOL as a defense? If so, where can I...

Which State's SOL Applies in Judgement

non-pro answer I'm not an attorney, but I believe the laws of the state in which the suit is actually going before the judge is going to have to apply. How could it be any other way? That judge only has jurisdiction with the laws of his/her own state.

Sued today for 3-4 year old credit card debt

P.s. I also checked all my 2002 statements, and 2003 as well, to make sure I didn't make any payments since then. None.

Sued today for 3-4 year old credit card debt

It HAS been over 4 years...!!!!!!!!!! Am I in luck?! I just was able to access all my old bank statements online. I have only one bank account and only paid through that account, whether by check or debit card. I checked every single statement for 2001 and my very LAST payment to Discover was...

Sued today for 3-4 year old credit card debt

Oh my. One question, though it's after the fact: what if I had refused the certified letter I got today? What would have happened? I almost didn't accept it, but since it was from a Constable I was afraid it would be illegal to refuse it. Thanks for all your help. No matter how bad things get...

Sued today for 3-4 year old credit card debt

What is the name of your state? Texas It's been over 3 years since I last made a payment to Discover card. They sold the debt and now an attorney in Georgia is sueing me for nearly $20,000. I'm a single mom with no child support, a car worth less than $1500 and live in a rental apartment. I...
