I bought a used car on saturday. When i purchased the vehicle me and the seller signed a contract . My biggest issue is that at the beginning of the contract it says car sold as is but i managed to convince the seller to edit it and write at the bottom that the...
i think you should see an attorney because to me it obviously seems like you are hiding something that might have you criminally charged
there has to be a reason for you not wanting to talk to the police and it must be pretty serious if when they knock on your door u dont answer
nice euphamism for ur stupidity
well thanx guys for the smart ass comments i expected it but anyways ill be more specific

the more and more u seem to explain the less and less i understand but thats ok its not up to me or you it comes down to what the judge thinks and since it is then theres situations whre the judge will agree with you and situations where the judge might agree with me so well just leave the judge...
I wasnt specifically talking about my case i was referring to what u said which was that your legally abided to do a citizens arrest which means that you have to arrest on probable cause and what i said was that a person should be mirandarized because i know no matter what said that a person is...
So now your being a smart ass oh well typical of police officers they got huge ego's so i can understand that defeat is not an easy thing
thanx for the info i dont want to be here for ever
so you as an officer would make sure that your questiniong fits in to a way were a miranda vioation does not occur how funny thats like basically going around the system im sure like u said its base on the totality of the circumstances and this argument has a chance of holding up in court
That is the same case here in arizona now since it would be illegal for you not make a citizen's arrest then when u take the suspects comments wouldnt you say that u have to mirandarize him because hes going to be in custody
thanx guys yeah i understand how the law goes eventhough what im saying makes sense
under the way the miranda law is written probable cause is not considered custody but it damn well should be thats my opinion i dont know any normal person (except for lawyers) thats in front of a police...
thanx lawgirl for clarifying it a bit but yet my answer was not answered i cant see how probable cause works like i said if the police officer already knows hes not going to release the suspect w/out letting the suspect know does he still have to mirandarize him because yet the suspect might...
what was i suppose to do to me sorting this out is important when a police officer tells u hes going to issue an arrest warrant your options are limited eventually you have to go to court so either way i was screwed i joined the navy and any type of legal troubles i get into can disqualify me...
your right in the sense that yes u just cant make an arrest cause u want to but i clearly stated that if the officer has probable cause to make an arrest an their is sufficient evidence where the crime consist of an arrest if the police officer does not arrest wouldnt he not being doing his job...
your aboslutely right

a miranda right violation because...
