Hi. I'll apologiize right away for the upcoming novel I will be writing. :o)

My daughter was in a horrible car accident in 2002. She & some of her friends were in a car & when they went to stop at a stop sign, the road was icey, which made them slide into the path of an oncoming SUV. My daughter was in the front passenger seat which the SUV directly hit. They had to use the jaws of life to get her out & then life flighted her to a large critical care hospital. Her best friend in the seat behind her was killed. My daughter spent 1 1/2 weeks in critical care with several fx's in her pelvis & a fx'd sacrum. My husband & I are not suing people & never even considered suing the driver of the vehicle (she had marijuana in her system at the time of the accident). The state of MI did prosecute her, she was 17, our daughter was 15 at the time of the accident. The driver's insurance company contacted us stating there would be a settlement amount given out to all parties involved ( our daughter, the girl who died's family, another girl that was in the vehicle with similiar injuries as my daughter & any one that was hurt in the SUV that collided with them. Well, 1 1/2 years have pasted & we have heard nothing from the insurance company until last week we rec'd a letter from a lawyer representing the insurance company. We talked to the lawyer & he stated that we have to come up with some monetary amount to settle this claim.

Our daughter is walking & talking & she's alive, we're ecstatic about that & told the lawyer exactly that & we were lucky to have her. Lawyer stated again that we need to come up with a monetary amount to settle this claim.

Since the accident my daughter was told by her physician that she will never completely heal & she will always have pain. Winter & rainey months she is crying most of the time because of the pain in her lower 1/2 of her body. She can only stand for about an hour w/o pain & only sit for about an hour w/o pain. She has been diagnosed with clinical depression as a result of feeling the grief & guilt of her not dying instead of her friend. We also were told that it will be highly unlikely that she will be able to have a natural child birth, if she chooses to have children, it will have to be a c-section with the way her pelvis is now twisted from the accident.

Please don't take the previous paragraph as her life is miserable. It's not, she deals with the pain everyday & goes on with her normal activities.

Again, we are not suing people, but are being forced to come up with a number. Can this number be to pay for our daughter's college? Do we tell the lawyer that that is what we are wanting the $$ for or do we have to put a price on her pain & suffering? Our daughter has always planned to go to college, she will need a good education to help her find a job that will help her out in the long run when the problems with her body come to a point where they will have to be looked at again.

We are not looking for $$ that will provide for her forever, just enough to pay for the college education that will give her the opportunity to be able to handle the future problems from her injuries when they arise.

Let me know your thoughts.

You'll need to come up with a specific number. Like any negotiation, start higher than you actually want so you have "bargaining room". And know that whatever they offer you, it's probably a lot less than you would get as a result from a lawsuit.

Yes, I do realize I will have to give them a number, I've been doing all the research I can on an approximate cost for the schooling. Should I flat out tell them that is where I am coming up with the number? Or do I just give them a number with no explaination?

You don't owe them any explanation and I personally wouldn't offer one. It's none of their business on how you come to your valuation and only gives them the "upper hand" in the negotiations.

It wouldn't hurt to talk to a lawyer. The first visit is usually free and perhaps the lawyer could give you a ball park figure.
