What is the name of your state? Maryland

Can a chapter 13-5year plan be modified due to a job loss? If so, how would this be done? Would they dismiss this one we have and make us start over, or, would they somehow modify the plan payments to a lesser amount each month? Will this have some negative impact on us for having to modify? The reason I ask is that my spouse had a temp job that was a 1 year assigment. I explained this to our atty at the time we were filing. The atty said we would have to wait until it actually happened before we should say anything to the trustee about it. So now it has happened. He temp job is over. The temp service has said they do not have any other job for him to go to right now. He has applied for several jobs but nothing he has not been offered any position yet. I believe his age has a lot to do with it, (even though by law, it shouldn't). He is 62. Can someone please explain how this would work, what we need to do, and what bad will happen to us because of this? The 5 year plan included this temp job as monthly income. Now this $987 monthly temp job is gone. This is beyond our control though. He is trying to find more work but is not being offered a position anywhere yet.

You need to get in touch with your lawyer and get the proper papers filed to modify your Ch 13 plan based on your current income level. The lawyer shouldn't have a big problem with this, and neither should the Trustee. If your husband is going to be out of work for long, and you can't make even the modifed payments, you may have to consider converting to a Ch 7, which, again, is basically paperwork the lawyer needs to file.
