I know that this thread was also included below, but I wanted to make sure I was correct for CA. I was told recently that if I voluntarily resign my position (inside sales, salaried, no commission) by giving 2 weeks notice and my employer requests that I leave that day, that I should get paid for the 2 weeks as if I had worked them. The person who explained this to me was certain that if I wasn't paid for that time that I could take it up with the Dept. of Labor. He seemed pretty certain about it. I know that as soon as I turn in my notice, that day will be my last there.

Your informant is wrong. Nothing in the law of California or any other state requires an employer to pay you for a notice period that is not worked, even if it is not worked at the request of the employer. While many companies will voluntarily pay you for a notice period if they accept your resignation immediately, they are not required to by law and the DOL is not going to force them to.

However, in many states (and while I am not 100% positive I believe California is one of them) if you are not paid for your notice period you can collect unemployment for those two weeks.
