What is the name of your state (only U.S. law)?
New Hampshire

Over 20 years ago I was driving in Massachusetts , arrested, and appeared before a Massachusetts judge. I agreed to take a class, and the case was continued and dismissed without a finding. I was living in NH at the time.

Now, I'm applying for a security position in NH and the states security license. The application form asks "Have you ever been arrested for or convicted of a crime that has not been annulled by a court? (Except traffic violations)

Is OUI a traffic violation? I'm now not sure what the arrest charge was whether OUI, or crossing a line making a turn.

I am in the process of getting the paper work from the court, and will also apply to have it annulled, but the employer want to move things along and I doubt there is time to finish the application the annullment.

How do I answer the question?

Thanks,

Paul

OUI is a misdemeanor in Massachusetts, not a traffic violation.

Technically, CWOF is not a conviction. However, the form asks you if you have ever been arrested for a crime that has not been annulled by the court.

The truthful answer is that yes, you were arrested for a crime that has not yet been annulled by a court.

Thanks ElvinMelvin. That's pretty much what I had expected. It's good to get confirmation.
