What is the name of your state?California
I have a friend and he and his now ex-girlfriend were both on the lease and she moved out and has been out of the apartment for over 30 days. She failed to take her name on the lease, so both of them are still named on the lease. The manager won't change the locks on the apartment without her approval and he has noticed things missing in his apartment. What can he do? Hasn't she abandoned the apartment? How can he get her name off of the lease. :confused:

You might try asking her. If the LL is willing to allow her to be dropped from the lease and the former tenant is willing the LL can do this. You might explain that the former can be held liable for the terms of the lease as well as the current tenant. This might include any damage at lease termination and such. (BTW this is not meant to infer you should damage the place). It might just give the former a reason to want to be off the lease.

He already asked her, and she was suppose to when she left and she never did. Her credit is already bad so she wouldn't care about that. The problem is that she still has a key and when he is at work she came in and took some of his property, namely a box of condoms and some of his cologne. She one of those psycho ex girlfriends.

Well what kind of agreement did the two of them have as far as shared rent atc.

If he wants to push it he can file a small claims suit to recieve any monies agreed upon but not paid. Most here will tell you this will be difficult but what you are trying to get is her name off the lease.

Additionally most here also beleive that although you are both liable to the LL neither one can claim against the other for 1/2 of the rent if the other fails to provide same. I tend to disagree but I am in the minority here on that. If you are willing to give this a shot he can try to sue for 1/2 of the rent per month. Don't know if it will get you anywhere but it will get her attention and maybe into court. But here again the goal is to get her to drop from the lease.

He wasn't griping about the condoms or the cologne, he was griping that after 2 months she is still going into his apartment while he is at work. He hasn't had any contact with her in those 2 months and he walks into his apartment and feels like someone has been in his house and notices things missing. Those were just some of the things he noticed missing. :eek:
