Hi all,

I just got my second speeding ticket this morning in less than 24 hours in which so happened to be by the same cop but on the complete opposite side of town as yesterday. Anyway, he cited me for going 54 in a 40 and today going 57 in a 40. He was on a motorcycle both times when he pulled me over. This second time this morning, he said had I not passed the person I passed, I would have been fine. Both times he was parked watching traffic too.

With that being said, I decided to read the ticket over again and noticed where it says "Measuring Device Used" where my marked speed and posted speed was, it is blank... as if he didn't use anything to measure my speed. I've seen several tickets from other people where it indicates how the speed was measuredIs this something I should contest to in court since it's 2 tickets now that say it or should I just do the driving school?

I assume you'll only be able to do traffic school for one of the tickets. Whether you challenge one or both is a decision only you can make. Of course, conviction of one or both charges likely will impact your auto insurance rates.

The ticket is just notice that you were cited. What is or isn't filled in is usually irrelevant because the officer will have the opportunity to present all that in court where it counts.

I'm not sure but I think you have to plead not guilty before you can request discovery and get the officer's notes.

You may be able to get the first ticket dismissed by going to traffic school. Check on that. If eligible I would do that this week (you might be able to do it online in just a couple of hours) and then deal with the other ticket.

He mentioned the same options to either contest it or do online school but said "I don't know what you're going to do about the other ticket" so I'm not sure what that means. You can only do traffic school once in a certain interval. Was 12 months between tickets before you could do it again. Might be longer now.

Generally, you take the class, get the completion certificate and you take the certificate to court before your hearing date and the ticket gets dismissed. Procedures may vary depending on where in AZ you are located so I suggest you call or visit the court and find out what you have to do. There is likely a list of approved courses that you have to pick from. It'd be nice if you can do the class online in a few hours. Last time I did one for a ticket was decades ago and it was 8 hours in a classroom with a lecturer. I took one online recently (voluntarily) for an insurance discount and it was only about 3 hours.

You mean never got caught before. LOL. I'll bet you drive 10 or 15 miles over the limit all the time. You would be wise to break yourself of that habit.

I don't know how things work in your unnamed county in Arizona, but court appearances are rarely required for garden variety traffic tickets. Typically, you only need to go to court if you want to fight the ticket or request payment arrangements (basically anything other than paying or traffic school).

Since you haven't written anything that even hints at you claiming you aren't guilty of both charges, you should either pay the other one or you can fight it and hope the cop fails to show up and the court dismisses the case (happens rarely, but it does happen occasionally).

I figured out how to go about paying one of the tickets and doing the online class for the other. Both are $250 a piece to take care of. I don't think I'm going to fight the ticket because if I plead not guilty and he somehow has a way to prove I was going those speeds even though the ticket doesn't say how he measured them, I'm screwed and it was a waste of time. It's a 50/50 chance and no odds in my favor.

Also, for those mentioning the county, I'm in Pima.

As you probably have realized, the officer's testimony is evidence. If he says he used whatever device, Arizona doesn't have a lot of procedural mumbo jumbo like other states.

Sorry if I'm not understanding because again, this is my first time ever getting a ticket. I know I can get one ticket dismissed by doing the online defensive driving school but the other one, I'd have to pay for?

You may be able to get it dismissed, but you will still pay for it, and the other one you'll also pay for, but you won't have it dismissed. The point that FlyingRon was making doesn't really apply to you. He was just pointing out that you can use online traffic school only one time in a year (based on the date of the violation).

Nope, you're confusing California's rules. Arizona you do not have to pay the fine for a DDS-dismissed violation. You only pay the fee for the driving school (which seems to run around $20. No fine, no points.
