341 hearing is done

Well I had my 341 hearing on Monday the 4th. I was pretty nervous and did not believe it but it took exactley 15 minutes.

1. So what happens now? do I just pay my monthly amount for 12 months, till its confirmed and then the remaining months till its done? ( as long as no one has any problems with it)

2. No more hearings except possibly the confirmation hearing?

3. What about my receipts I am keeping, will someone want to see them and verify what I put down on the BK?

I am going through a divorce also and my stbx tried to stop the bk and protect her interests. Basically was told that she has to take up any possible foreclosures with the mortgage companies and the bk court does not protect her interests, she has to do it.

4. Can a bk be brought up and disputed in a divorce court hearing? I am sure she will try and bring it up but would it get shot down.

5. She tried to say I miss-stated my income, no proof provided by her, I did provide proof to my bk lawyer and it was accurate. The trustee rep said she needs to file a complaint in writing and sent it to their office. if she does what happens then?

I'm not an expert on Ch 13's but I can answer some of your questions. Perhaps Elmo will answer the rest, he's very good at CH 13 questions :)

1 - Yes, keep making your payments.

2- Right. Unless there's some objection brought up, you're done.

3 - Doubtful, but until everything is confirmed/approved and the time for objections has passed, I'd hang onto them anyway.

4 - No. Bankrtupcy court far outweighs state proceedings such as divorce. She can bring it up in divorce proceedings all she wants, but the BK court has already, apparently, shot her down.

5 - If the Trustee finds validity in her claim, should she make one, then there's likely to be some investigation. As long as your lawyer has all the accurate information needed, then I don't see that it should be a big deal.
