What is the name of your state? CA
Today we had our chapter 13, 341 meeting. it went very well.
I WOULD LIKE TO THANK ALL OF YOU WHO ANSWERED MY QUESTIONS. Your help is greatly appreciated.
Any new people coming here looking for answers this is an excellent place to start.
They have a wealth of information.
Using the information I gained here I was able to ask questions when I talked to attorneys 4 in all and finally come to an informed decision on what to do chapter 13 versus 7.
We didn't hire the most expensive actually she was the next to the least expensive. One other note, the people that worked there seemed to know our attorney. I did do a search of the trustee web site and found her name as giving some type of training to other attorneys, that was one of the reason we hired her.
I learned more about bankruptcy in the last 1 1/2 years than I ever wanted to know.
Now in 34 more monthly payments we will be out of debt.
Our meeting went like this.
Our attorney said before we went in just answer the questions honestly, but try to keep them short and don't volunteer any information.
We were both nervous, but unlike the chapter 7 side there were only a few people in the meeting room, about 7 + attorneys.
One trustee started out by herself, after about 15 minutes and on her second case, the second trustee came in.
We went first with the second trustee.
At first she seemed a little anal, we had to sit on the right side of the room and the attorney of the left and a few other remarks, then raise your right hand swear that everything is correct etc etc.
The she started to look over our paperwork, as she flipped through the papers she asked a few standard question, repeating some of the questions on a form they make you fill out and sign. Have you listed all your asset and debts(yes). Then how did you get into this trouble, we stated "due to a business", (I started thinking this is where the questionable business loan would come in), what kind of business,( then she seemed to become very understanding, I see you sold your business in 2003 for $92,000, what did you do with the money, " we said that we used it to close out the business. She kinda cut us off and then said OK, and wanted to know if we had employees and did we pay all the payroll taxes due, we said "yes and the only taxes we still owed was on our personal income taxes listed".
She then said she was confirming our plan and there was no other hearings required.
the actual meeting took about 10 minutes. Our attorney said she believes why it went so well was that the paperwork was all in order and we answered the questions quickly and without hemming and hawing. She was somewhat surprised that a confirmation hearing wont be required as we are only paying back about 2% to unsecured creditors, but that was it.
So thanks again for the help
I hope I can come back from time to time and if I can give someone else some help.
