Well, I had my 341 meeting this morning. The meeting before mine was very complicated and nasty and must have gone on for over 45 minutes! By the time the trustee got to me he was speaking so fast I could hardly keep up with what he was saying. Two issues came up: how did I spend my tax refund? I told him the truth, that I spent it on food, neccessities, car repair and medical/dental bills. Then he asked about my wife's income even though I filed individually. I estimated her monthly income and he said he would have to see how the US Trustee wanted to handle that & it might turn my "no asset" case into a "minimal asset" case. What does that mean? I filed alone because the debts and assets are mine and mine alone. My wife has her own set of payments and bills! I told my attorney about this and he says not to worry about it. Really?

SOP really. He was probably pissed from the previous grilling you witnessed. Anyway, when there are 2 incomes, the Trustee will look at the other person's income in the household. If they think there's enough money in the household to let YOU pay your creditors, they may force the issue.

You'd best be prepared to show your wife's income and all HER expenses just to CYA ;)
