I tried purchasing a home nearly 3 years ago. I put down a $5000 Ernest deposit. One of the contingencies was that I would be approved for for the loan. I was informed by the lender that I couldn't be approved. The contingency was never removed, and the deal fell through. I asked for the deposit back but the seller wouldn't sign off. I have since asked the escrow company several times for my money, tried to arbitrate with the seller, but to no avail. The title of the house has since changed, and the esscrow company still wont return my money. Aside from taking everyone to small claims, does the escrow company have the right to keep the money until she signs off on money that should have been returned 3 years ago?
