I was driving on US 209 N. following the speed of the car in front of me. As we came around a bend there was a state trooper parked, the vehicle in front of me hit his brakes, and I followed suit, however the police officer pulled out behind me and after approximately 1 mile he pulled me over. The officer verbally stated that I was doing 76 in a 55, I am not actually sure how fast I was going, I was just following traffic.

After some brief conversation confirming my address on my license (I live nearby) he went back to his car. When he returned he issued me a ticket stating that I was doing 60 miles an hour in a 55 using a timing device indicated as radar (Handheld.)

My question is, can I plead not guilty and have the ticket dropped because it indicates I was only traveling 5 miles an hour over the speed limit? From what I have read it is speeding to drive even 1 mile an hour over the speed limit in Pennsylvania, but not fined up to 5 miles an hour over.

My second question is, he stated that I was traveling 76, yet find me for 60, is that not falsifying information?

Thanks!

The cop cut you a break by not citing you for the 76 in a 55...do you really want to press your luck on this one?
