What is the name of your state? What is the name of your state? MVA was in MD

I will make this as short as possible, not sure how much detail is needed. I am wondering if the SOL is coming soon? Any feedback would be helpful.

July 6, 1998, I was a passenger in a vehicle driven by a friend of mine. This friend was driving his vehicle northbound on I-95 in Laurel, Maryland. There was a vehicle operated by 1st Defendant that began spinning out of control coming from the right side after colliding with a tractor-trailer operated by 2nd Defendant, who was also traveling northbound on I-95 in Laurel, Maryland at the aforesaid time and place. After seeing this we started to slow down and a vehicle operated by 3rd Defendant struck us from the rear, the vehicle that collided with the tractor-trailer hit the passenger’s side of our vehicle where I was sitting. The 3rd Defendant that struck us from the rear was also struck from the rear who would be the 4th Defendant.

I hired an attorney in July 1998 from Alexandria, VA. And as a result of this occurrence, I initially suffered with an aching and stabbing pains and spasms in my lower back and interscapular region with pain radiating down my right extremity involving the dorsum of the foot. Prior to the accident, I had no such problems. I also suffered weakness in the upper and lower extremities. I also suffered with pain in my knees and wrists. An MRI on August 11, 1998 showed soft disk bulging at L5-S1 causing compression over the dural sac. I was diagnosed with L5-S1 radiculopathy. I also had a difficult time sleeping and suffered from depression and was totally temporarily disabled.

Every 3 to 5 months I would call my attorney to find out the status of my case but nothing ever became of the phone calls. The lawyer would never return my calls or emails and when I did get him on the phone he would rush me off. Sept. 22, 2004 I called the court house, District Court of MD for Montgomery County to find out what the status of the case was. The clerk at the court house instructed me that the case was "about" to be dismissed for inactivity for 3 years. The lawsuit was filed with the courts in Jan 2000 then left dormant until he did a file reissue with the court on or sometime after Sept.2004.

After speaking with the courts I threatened my attorney with legal malpractice, he then became active again. He had all 4 defendants served in late 2004 and we had a court date set for Feb2005 and he filed a continuance, then again a court date was set for May 18th 2005 he again filed a continuance. He did not call me nor did he return my calls until the day before the 1st trial date and he still did not know if we were going to trial until the next morning, day of the trial Feb2005. I called him today May 11, 2005 to find out if we were still going to trial on May 18th and that is when he let me know about the 2nd continuance.

Sorry so long.
Thanks, Tom

looks like it is time to find a new attorney. then file a complaint with the State Bar against your old attorney.

I think you are right

I just hate to think we are finally about done and to have a new attorney take over now would mean it would be put it off even longer.

Thank you

Tom
