A big mess

First off I know people are very very busy, but could someone (that has a law background) look over this contract and highlight/explain some parts that might not be valid.


Okay, now my problems. I ran into this company at a local fair by my house and was promised a job upon formal (verbal) agreement. About 2 months later the man finally got around to giving me my contract. The originally salary verbally guaranteed to me was 35/hr, the contract said 27.50/hr. I naturally took the job because 27.5 is much better than 8/hr working at retail store during college. I started working on a project for 3 weeks, the company changed the way I am supposed to login and do my work. I can no longer get in to do work! that was 1 1/2 weeks ago. I have been trying to get a hold of the guy (call everyday) - (email once a week) {to get paycheck and login information} for that time now, no answer. He owes me for 3 weeks of pay, 10 hours a week (30hrs). My parents/family friends think he is dragging me along on a trip.

What do you think would be the best first step? We are considering small claims court for my paycheck and court costs.

I am unclear if it legal to state that a contract falls under another state, as the contract sais. Please help! Or maybe point me to some good books to research my case.

That's not an employment contract. It IS a non-compete/proprietary information agreement but nowhere does it bind both parties to a specific length of employment. All it says about your actual employment is that they'll pay you $27.50 per hour. It doesn't even say how many hours you'll be working. Additionally, there is also an "at will" acknowledgement so the long and the sort of it is that you do not have an employment contract with these folks.

I agree with your parents that you're being taken for a ride.

What you need to do is contact Ohio's Department of Labor and file a complaint for your unpaid wages. And start looking for another job.

By the way, are you Henry? If so, then while you may end up the CEO of a Fortune 100 company some day, no reputable business puts an unknown college kid on their Board, much less as Vice Chairman. In the future, make sure you're dealing with a reputable employer and remember - if it sounds too good to be true, it probably is.

What I think is that you don't NEED to go to small claims court. Contact Ohio's Department of Labor and file a complaint for your unpaid wages. That's what they're there for.

Intentionally? I wouldn't imagine that's very likely to happen but if it does, complain to the manager.

Complain to the manager??? The waiter just intentionally scalded my "boys" with Campbell's chicken noodle soup. The manager??? I can't speak for anyone else, but I'm going to complain to the fire department and the urologist.
