I live in Florida, and have been working for Hess Express (a gas station) for 9 years, recently I was promoted to manager. I had been given a write up a few months ago because an employee in a section of my store called Blimpie's (a food section) had been pocketing the money which came out to be about 9,000.00. Being the Manager I was responsible and got a write up and lost my bonus. The employee never had to pay a dime of what he stole. My question comes now, On our registers we are only supposed to be running them if our names are logged on to the register. Well my drawer usually is opened by my employee's about 2am and not closed till the very end of the night, therefore my employee's have been running my register. During this time period a few people made returns and kept the money. My boss called me on a Wednesday i believe and told me their was a shortage in cigarette's which people have also been stealing. He waited 2 days after Wednesday (had me work for 2 more days) and on the side of the bulding fired me for the returns people made on my drawer, and my cigarette count, in front of one of my peers. I just want to know if he can fire me in such an unprofessonal way, (on the side of my place of work, and in front of a peer). He also said I have to pay for all of the money that was taken from my register which I did not take. He didn't take the time to investigate the times the returns were made, and compare them to the times i was clocked in for work (which wouldn't have matched). he also said, "Didn't you know you were CAPPED" (referring to the episode of stolen money of 9,000.00 from an employee). I want to know, 1.) if the way i was fired was unprofessional, and what i can do about. 2.) If I have to pay for money that there is no proof of me taking 3.) why I would have to pay for money with no evidence of me taking it, but the employee that had pure evidence of stealing 9,000.00 doesnt have to pay a dime and last of all, 4.)i was told i was not to let other people run off others registers but a few days after I was fired and replaced by another manager, That new manager was running off of someone else's register in front of the boss who fired me....can I get him in trouble for this.

It is not against the law to fire someone in an unprofessional way. It's not how I would have handled it but he violated no laws; nor was it illegal to term you for this reason. You have no legal recourse in this regard.

I seriously doubt that he can legally make you repay the missing money, although your state tends to run slightly differently than most in this regard. Contact the Department of Workforce Innovation or whatever it is that you guys are calling your Department of Labor these days and ask them - if they are unable to help you, either call the Federal DOL or talk to a local attorney who is versed in employment law. This is SOLELY with regards to their expecting you to make repayment - nothing in your post suggests that there was anything legally improper about your being fired or the way they handled it, even if it was unprofessional.

If the manager wants to let your replacement handle things differently than he had you handle them, that's none of your concern.
