i applied to a job ad on the local Craigslist back in the end of October. I originally indicated that i needed a valid email address since i was not going to send my resume (with personal info) to a craigslist email. so i got a response the next day and forwarded my resume. i then received an email back with a copy of the job description and asked if i liked the job. apparently this employment agency sent me the wrong description of the job i applied for and then when i called got a new one. apparently the employer liked it and questioned a couple of things on my resume and i was told by the employment agency now that it was close to thanksgiving that they will not be doing any interviews. well apparently a job alert came to me for a different position from careerbuilder and i applied for it. i received a phone call after thanksgiving from the employment agency saying how dare i apply for a different position since it was with the same company and that i am to go through them and not do that. i explained to them that i did not know it was the same company since no one told me that it was. they never released to me the name of the company that i originally applied for. the guy from the employment agency had major attitude on the phone with me. now i feel that because of the mix up, they will not help me get either one of the positions. should i call the actual company (not the employment agency) and explain the confusion and see if i can get an actual interview? i am qualified for the position and fit perfectly for both of the positions. i feel i am getting the run around from the employment agency.

The agency is under no legal obligation to consider you for any position with any of their clients.

I'm not sure what advice you're looking for.

And if you are qualified for both positions, there are still probably 300 other people who are also. If they are not willing to assist you, there is no legal violation there; all you can do is let it go and move on.
 
i guess my question is, should i contact the potential employer, explain the confusion and see if i can go directly through them for possibly obtaining an interview instead of dealing with the employment agency?

No employment agency has the right to restrict you from applying from any jobs you wish to, unless you've signed a contract with them to the contrary. The fact that the guy reamed you out for seeking and applying for whatever jobs you're interested in tells me that you're not dealing with a reputable employment agency.

It's not clear to me whether the job advertised on career builder was through the employment agency or placed directly by the employer. If the latter, by all means contact the employer directly and express your interest. If they're all through the employment agency, then it appears the employer has made a decision to do their recruiting through them and there likely is not much you can do.

BTW, I'm assuming you are referring to a staffing agency, i.e. the actual employer is the staffing agency and they place their employees with client companies. If they're a contingency firm (the employer hires directly but pays the employment agency a fee for each hire they find), then contact the employer directly regarding both opportunities.
 
Thank you, Thank you. The employment agency only advertised for the first position. the second position was by the actual employer. no contract was signed with the employment agency at all. i will contact the employer directly and hopefully, be able to get at least one of the positions.
