I am planning on filing a motion for abandonment against the X-wife in NJ.
My ? is does CS still add up if her rights are terminated?
We haven't heard from her but maybe 6 times in 6 years and now haven't heard from her in years. They last seen her for 5 minutes 2.5 yrs. ago. and then once a 1.5 years before that. No cards presents calls nothing.

If her rights are terminated so are her responsibilities and obligations -- meaning no more child support accrues.

Maybe I'm going about this the wrong war, but.

I am sick and there may be an adoption in the future. My other concern is I own some property and the kids will have some money. Even though I set everything up thru an attorney I am told she will have first access to my kids no matter what my will says and the money. (If she shows up there are warrants for her in several states and she's looking at jail time, among other things she stole thousands from the kids already) No matter who I leave it in trust to or if I just leave it to anyone else. If her or her family gets a hold of anything these kids have it will be gone within weeks and the kids will be living on the streets. That is a fact !
I am hoping to make just more hurdle for her in the courts to stop this.
I am open to suggestions?:)

You set up a trust fund, with really specific and tight rules about when the kids get any money, and you set up people you trust as trustees.

You can say that the income from the trust can be used to pay educational expenses, medical bills, or whatever other specific things you name, and state that the trustee is to pay those funds directly to the provider, not to the child's custodial parent or guardian.

You can also set it up that the kids don't come into the principle until they are 25 or 30.

However, as far as custody is concerned, you can express your wishes in your will, but mom will be first in line, then grandparents (both sides) will be second in line, then aunts and uncles (both sides) will be third in line. That doesn't mean that someone that is third in line can't win out over someone ahead of them, but it does mean that mom would have to be found unfit.
