Hello,I was just wondering about the grounds for my husband adopting my son.My son's father hasn't been around for a year and hasn't paid a dime in child support since he's been born,he is now 2 and 1/2 years old will be 3 in May and has maybe saw his dad a total of 2 months since he's been born and he never showed up for the past 3 court dates they gave to him about having visitation rights.Does anyone know if they think my husband has a good chance of adopting my son which has been around since he was 3 weeks old and my son calls him daddy,can they make the real father sign his rights over?We are in Ohio!

I am a law school graduate. WHat I offer is mere information, not to be construed as forming an attorney client relationship.


You need to do two things:

1. Find real dad and have him terminate his parental rights. That way, he is not legally the father and he does not have to pay suppport.

2. Then, you take this court certification and have your husband use to adopt your child.

3. If #1 doesn't work, you need to make a motion to have the court determine (ex parte) that real dad abandoned child and as such, court will terminate his rights.
