return kids to abuser/(possible)molestor?

What is the name of your state? Michigan

The children's mother has custody, and they live with her in California. They spend summer's with father in Michigan. They are 9 and 12 yrs. old. Mother lives with her boyfriend. Children say he is abusive, and has been arrested for raping a family member, and that they were instructed by the mother not to tell their father. Father worries whether his daughter was molested, though she says no, and that both are being abused by the boyfriend. The police say they can't do anything or look into the records because it is an on-going investigation. Father can not afford a lawyer, and will have to send his children back home at the end of summer. What are the options? Thank you

Failure is NOT an option

Daughters being abused! Possibly sexually!!

Waste NO time! Get an attorney. Do NOT make excuses that Father can't afford it. These are his kids, and their safety is at risk!

You have until the end of summer to raise lets say a thousand bucks. $150 a week x 6 weeks = $900 Make a commitment to work overtime, second job part time for both of you, or borrow the money. Friends, family, credit card, etc..

You will need to file a motion for temporary custody requesting a hearing. It will be accompanied by an affidavit alledging the children to be in "Immediate Danger"

If your financial situation is in distress, I have some other advice.


Suggestion#1

The motion and affidavit can be prepared by a paralegal service for far less than an attorney. You may file the documents with the court and await the hearing. 1 week before the hearing retain an attorney to appear in court with you for the hearing.

Thank you for your help, I will pass your information along. These kids are my niece and nephew- I'm praying the father will fight for them. There is no possible way he'll be able to get a lawyer, and I can't help him out there, but am doing everything I can for them. Thank you so much!

Hattie does your county govt center have some one who would atleast be willing to interview the children and perhaps help make a evaluation ? or if near a larger town where it might be easier to find counselors who specialize in abuse victim counseling could be found for private evaluation ?

Yes there is, Farmer, and I think that will be his next step. But, the police and social services say there is nothing he can do while the boyfriends case is pending. It's too confusing to know what to do, yet obviously something has to be done!
