What is the name of your state (only U.S. law)? Louisiana

Son was driving company vehicle on errands for me (I was his immediate superv.). He was involved in an accident with an armored car. Upon my arrival I saw two ladies (who did not appear to be injured) being sent to the ER. Now understand this, the armored car suffered little damage. While on the scene I observed that there was a folding lawn chair in the passenger seat area. I asked the trooper if someone was in that chair and he said "no". I don't think they would admit to violating the law and company policy. Well anyway son is now being sued. Company was self insured for the first 20-25,000. Insurance for the balance I guess. Witness said he stopped for the red light. He thought the light turned and he proceeded forward and hit AC in the intersection as she was turning left from a deceleration ramp. He passed his mandatory drug test. He was issued a citation.

Question: How is he able to be sued personally when he was in a company truck on company business? If he can is there any recourse for him against the company for inadequate coverage?

Driver and owner can be sued (whoever has insurance or money/assets).

But your entire description makes it difficult to determine who was driving what, much less what happened.

why is the company's insurance policy inadequate? They were trying to save money. In any case, as long as your son in properly insured, he has nothing to worry about, right?
