What is the name of your state?NY
Okay, this is what I want to know. I rent a truck. They refuse to let me see the contract until I return with the truck (I can prove this). They tell me I have insurance, so I rent the truck. If I did not take the truck right then, I would have had to cancel the move with associated costs. I bring the truck back damaged and find the contract says, "This is not insurance." The damage is not covered under some exclusion I was not allowed to examine until after the accident, and they led me to believe I had genuine insurance.
Contract of adhesion with misrepresentation, as I understand it.
Strong case?
Weak case?
Is the contract clause completely invalid?
Thanks.
