What is the name of your state? Virginia

Hello

I recently switched jobs. My former company recently put in place a new policy whereby employees receive no vacation hours until their hiring anniversary. Originally when I was hired, the policy had been that an employee accrued vacation time during the year. Under the new policy, when an employee ceases employment, my former company pays the employee for un-used vacation time from the previous year, but not for un-used accrued vacation time from the current year.

Is this legal? Do I have any rights to demand payment for my accrued time? My wife worked for the same company and recently quit. She is in the same situation, but has accrued more time.

I have heard that federal employment law does *not* require compensation for vacation, but varying states have different laws on the subject? Is this correct? How do I find out the Virginia laws?

Thanks

"Is this legal? " Yes.

"Do I have any rights to demand payment for my accrued time?" No.

"I have heard that federal employment law does *not* require compensation for vacation, but varying states have different laws on the subject? Is this correct?" Yes, this is correct.

"How do I find out the Virginia laws?" The state of Virginia does NOT require the payout of vacation time. It is entirely up to the employer to determine whether they will pay out vacation time on termination or not.

OK, thanks for the reply.

I was of course *hoping* for a different answer. Sometimes European-style labor laws seem like an attractive thing, especially from the perspective of the employee...

There are states that do require the payout of vacation on termination - mine, for example - but unfortunately you live in one that doesn't. Sorry I can't give you a different answer! I agree it doesn't seem fair, but as I told someone else earlier today, it doesn't have to be fair, just legal.
