I recently switched jobs. My former company recently put in place a new policy whereby employees receive no vacation hours until their hiring anniversary. Originally when I was hired, the policy had been that an employee accrued vacation time during the year. Under the new policy, when an employee ceases employment, my former company pays the employee for un-used vacation time from the previous year, but not for un-used accrued vacation time from the current year.
Is this legal? Do I have any rights to demand payment for my accrued time? My wife worked for the same company and recently quit. She is in the same situation, but has accrued more time.
I have heard that federal employment law does *not* require compensation for vacation, but varying states have different laws on the subject? Is this correct? How do I find out the Virginia laws?
