my relative was accused of stealing from an employer (she wasn't)... she was a bartender and was told that she gave away free drinks and stole money from the register. She was told to leave and when she argued that she never stole anything nor gave free drinks the owner said he'd call the police to escort her out. She told him to do it.. that she'd actually do it herself. The police came and he told them she was stealing.
Since then she has been having trouble getting a job because she is afraid to put them down as a reference. The owner of the establishment was a serious alcoholic as was his wife.
The police department did hear the accusations so she does have a witness. Does she have grounds for a legal suit? P.S. the couple have accused many people of the same and fired them as well.

As of right now, no, she does not. It is legal for them to fire her on suspicion of wrongdoing, even if they are mistaken. It is her own choice not to list them as references, so they can't be blamed if she doesn't get a job because of that gap in her resume.

IF she lists them as a previous employer AND IF a prospective employer calls them AND IF they say she was fired for stealing AND IF she does not get a job BECAUSE OF that statement, THEN she has legal recourse.
