Accident out-of-pocket expenses?

What is the name of your state? Ohio

I was in an accident in Ohio- the other driver was at fault, (and pled to the ticket). I filed a claim with his insurance company for the repair, but they denied the claim. I had to file a claim with my insurance company, and they picked up the repair.

Question is:

While my car was being repaired, I had to pay for a rental car (I did not have rental coverage). Can I sue the other driver for my un-reimbursed, out-of-pocket expenses related to the collision (i.e., the costs of the rental car)? What about any possible punitive damages? (I do not plan on suing later on for bodily injury- I wasn't hurt, and I don't work that way!)

Just because you receive a ticket doesn't mean that you are at fault for the accident. Just because you DON'T receive a ticket doesn't mean that you are NOT at fault for the accident. SSSSSSSSSSSSSSSSSSSSOOOOOOOOOOOOOOOOOO, describe the accident, and explain why the other party's insurance company denied the claim.

I was cut off at an exit eamp (a left exit), and the other vehicle struck me with his rear-driver side corner to my front passenger corner (again, this was a left exit). The other insurance company denied the claim due to differing statements and no witnesses (well, it was on the freeway, and of course he's not going to admit responsibility...)

The crux of my question is NOT do I have a case, but is it possible for me to sue the other driver directly for my un-reimbursed out-of-pocket expenses (i.e., rental car)? What about suing for any punitive damages? But NOT medical expenses... I don't want to go there...

Sure, anybody can sue anyone for anything. But, I'll leave my insurance expertise to those who want it.

Your insurance may be pursuing the other driver's insurance in an attempt to be reimbursed for your repair costs. If they are successful in getting them to accept liability, then a lawsuit won't be necessary. If they're not, there's probably a reason for it (such as they don't think it's possible to prove the other driver was at fault). So you should talk to them before you decide to sue.
