Another question:

If the adoption IS vacated, what kind of standing would mom ahve to pursue custody/parenting time over Dad...???

Enquiring minds and all that.

You mean FROM dad?

Mom has no status quo that puts her in a better position- she has not been parenting this child. IMHO, her actions make it clear mom would do anything and commit any fraud to deny dad his parenting rights and would thus be the inferior choice as the residential parent.

While I cannot disagree with you there WAS an adoption agency involved here and we do not know what the adoption agency told mom...or even what dad might have said to mom in the heat of anger. While the odds are that mom acted with fraudulent intent, there is also the possibility that the adoption agency guided mom to a great extent.

However, bottom line this situation is horrendous and everybody, except perhaps dad should have to deal with the consequences of their actions. Unfortunately, if the appeals process takes as long as it can, the child is the one who will suffer the most.

Really? The adoption agency guided mom? Mom is just a poor innocent lamb who lied to the court and committed fraud after MOVING to a different state in order to give away her child. Sorry but no. Mom is a lying pathetic excuse for a mother. Did you see the interviews with mom? Did you read the articles? Mom admits that she told the adoption agency that dad lived in Texas (at her former address). The adoptive family admits they were TOLD that dad had a right to contest. Neither mom nor the adoptive parents are to be pitied. Talk about a mom-bias.
