Adoption of Grandchild

What is the name of your state (only U.S. law)? Indiana

Our daughter had a daughter who's father has signed papers to give up his parental rights he has moved to California. When the papers were sent to her biologial dad our grandaughter's stepdad was going to adopt but that has now changed. We as grandparents who have legal guardianship now would like to do the following if possible. Let mother still retain her rights and let go of guardianship and have the grandfather adopt. Is that possible? My daugher is okay with this. Her stepdad is okay with this.

why doesn't the stepfather want to adopt?

was the parental rights terminated on the basis of stepfather adopting?

was the termination finalized with a judge's signature?

does the father know about all this?

why do you have legal guardianship and not mom?

In a word...NO!!! You can not have mom remain MOM and grandad be DAD...ewwwwe!!!

It is quite possible that Dad's termination of prental rights will not be enforced since planned adoption is not going through - therefore Dad remains Dad.

Grandpa cannot adopt unless daughter gives up her rights. Think rationally about this -- the child's biological mother would be mom and the child's biological grandfather would be DAD? Seriously? There are laws AGAINST incest. The child's father still has his rights until an adoption takes place.
