What is the name of your state (only U.S. law)? Florida

I am 35 years old and am engaged to be married, unfortunately I have never been able to have children. We were thinking that we just would not have any. With that being said you can imagine my surprise when a dear friend of mine ask me if I would be interested in adopting her daughters unborn baby. The mother has had numerous abortions and she has 2 little girls that currently her mother has custody of. She is in jail. She does not know who the father is and DOES NOT want this baby, we do. I want to know what do I have to do to legally protect ourselves. Can a birth mother just give her child to someone and allow them to adopt her child. I want to make sure everything is in order. She is only 4 months along and gets out of jail on December 18, 2010, so we need to know what to do to get the ball rolling on this. Thank you for your advice. What is the name of your state (only U.S. law)?

You and the mother NEED to hire Adoption ATTORNEYS to make sure both of your rights are protected.

Contact an adoption attorney. This is not a DIY project. The putative father(s) will have to be located/notified, among other hoops that will have to be jumped through.

First - slow down and take a breath - you need an adoption attorney to handle this - there are many legal in's and out's that only an attorney will know and can handle. You still have to get a home study, the possible father needs to be identified and notified of a possible adoption plan, the birth mom will possible get a state advocate as well as her own attorney to protect her rights. Since she is getting out next month - you cantake that time to find the right attorney for you. Good luck
