i was in a very abusive relationship with my youngest daughters father he has not seen her since january i have had to get a stay away order on him he has done jail time due to his dv against me and other women i am currently engaged to be married and my fience that i have known for about 5 years now wants to adopt my daughter how do i go about doing this?:confused:

You'll need an adoption attorney. And I don't know that you will be able to do what you want. I strongly suggest you read many, many posts here in the "Adoption" forum, and that you keep in mind that only NY law will apply to your situation.

To expand a little on what SilverPlum said, generally the State wants you to be married for a certain period of time before going ahead with a stepparent adoption.

Additionally, if Dad objects it may never take place at all.

Just because he has a DV conviction doesn't mean his rights will be terminated involuntarily.

And if Dad's going to fight this you will have issues.

Dad's only been away from the child for three months....

Is the restraining order in effect for the child, also? Did the child witness the violence?
