My husband and I have been together for 5 years, but married a month. My 10 yr old daughter has been in his care for 5 years. My ex-husband is a registered sex offender in a different state. For the last year and half since the divorce he has a no contact order in place by the judge. He hasn't seen her since she was 3 and a half months old. He has not given any financial support in 10 years. Do we need his consent for my husband to adopt my daughter? We would like to do this ourselves, as we can't afford a laywer.
We have no problem having a home study done, just need to know how to start the process.

You really will need the assistance of an attorney.

You and your husand also want to ask each other the following: If we divorce is hubby ready to pay child support? Are you ready to share custody with dad?

She should also ask if she is willing to pay her husband child support for this child if a divorce were to happen. Because that could happen.

Here you go, read this. It's from the NC General Statutes.

Adoption of a Minor Child by Step-Parent

http://www.ncga.state.nc.us/EnactedLegislation/Statutes/pdf/ByArticle/Chapter_48/Article_4.pdf

I read that and there is an exception to needing consent, but I am dealing with this danged laptop and I cannot get the search function to work to find that particular code. Its GS 3-48-602

I think that one needs to be read before we are certain of anything.

Nevermind...I got it and I do not think it applies.
