What is the name of your state (only U.S. law)? TEXAS

My wife and I have been talking to my 18 year old neice about adopting her son who is about to turn 1. She is 100% ready to give her son up as she cannot provide for him. She is not married to the father, in fact he is not even listed on the birth cerfificate. What is the process to adopt a family member under these circumstances? The father is not fit to care for a child. He does not have a steady income, cannot provide food or shelter and has been known to abuse drugs and alchohol. He is 36 and again my neice is 18!

The father has rights to his child, also, whether you think so or not.

Both parents will need to consent, and you will need an attorney, at least one. The parents may need their own separate attornies.
