My friend was beaten til near death by her husband. He was
convicted of 2nd degree attempted murder. Their son was 2 yrs
old at the time. Since then she has divorced him and re-married.
He has spent 5 of the 20yr sentence in prison. Her son has not
seen his father since. My friend's current husband has been with
this child since around 3 yrs. old he is now 8. He is wanting to
adopt this child. Does the biological father, who is in prison for
almost killing his mother, need to give consent to them for the
step father of 5 yrs to adopt this child? As a convict does he
lose his parental rights? The crime was committed in Louisianna
and this is where he is imprisoned. They live in TN and this
is where the adoption is to take place.

Under those criminal circumstances, in Indiana, bio dad's permission would not be necessary for an adoption.

My guess is that the laws are similar in Tennessee -- at least I HOPE they are.
