3 years ago an adult magazine was at a club I worked at. They were taking photos of girls on a harley for advertisement. I wanted no part of being in the magazine so i went on with my business. Later the photographer aproached me and asked if he could take some photos to keep on file for the club. I asked if they would be in the magazine, he replied no. He said they would be on file so if i ever wanted to shoot a photospread they would have my pic on file. He took some photos never asking me to sign anything or look at my ID. Come to find out they have been published in several issues of the magazine in the last 3 years. the photos appear in advertisements for the club, articles about the club, and who knows where else. Do I have any kind of a case against the club, magazine, or maybe the photographer? please reply with some answers these photos are not flattering and I feel my rights have been violated. any info will help!

As a general rule, you cannot use a picture of someone else in an advertisement without there consent, if the picture is used in such a way to imply endorsement or any other association with the product, service or place being advertised. However, this is all very fact-specific; you will want to talk with t alocal attorney, who can review ALL of the facts of the situation and advise you accordingly.
