What is the name of your state? New Jersey

I am a 34 year old born and raised in NJ. I am a deaf illegitimate child of a married man living in California. My mother passed away 2 years ago. Prior to her death she never persued child support from my married father. On several occiasions throughout my livetime he would come to see me and throw me a few bucks. His family in California does not know of my existance. Do I have any recourse to collect child support from this man? Thank you.:(

Child support is between the parents, not the parent and child.

Adult seeking support

Thanks so much for your quick response! Too late for that then, huh? Well, would you know if I have any other recourse? Like would I be eligable for any proceeds from his Will upon his death?

No, unless he lists you in his will, you will get nothing. I am not tring to be mean but you are 34 years old, your dad is in no way responsible for you.

My response:

Dott-the-Kangaroo, I am not "tryng" to [be] mean, but you need a dictionary to help you with your spelling - -

Hmm...not so sure about the will thing, but the child support is a no. I think I read a while back where some CA millionaire didn't list his out of wedlock children in his will (at all, no disinheritance clause) and they fought the estate over it and won. It's not part of your question, but have you tried communicating with him since your mother passed and so much time has gone by? Back then an out of wedlock child was such a no-no...but times have changed, maybe he has too? Just a thought.
Good Luck!

My response:

Hey Dott-the-Kangaroo - - have you ever heard of the term "Pretermitted Heir"? Look it up.

Sorry, i should have added that if your father has no will you might be able to get something but it will take a real lawyer to help you. Not one like LAAL that pretends to be a lawyer.

And just what the heck is "responcable" anyway?

My response:

That's exactly my point. Leave it to Dott-the-Kangaroo to KILL the English language.

P.S. On second thought, perhaps her spelling has something to do with Ebonics.

...Wasn't there a guy a few weeks ago that wanted his deceased bio-father exhumed to prove that he was an illegitimate child because the family didn't know he existed?

DAKNJ--Do you have anything that verifies him as your bio-dad? Birth certificate, paternity tests, something that will link you?

I have been away for a few weeks and hadn't had a chance to check the forum...Wow, what a great response I have received from my question! Thank you all so much for your advice and assistance. To answer your questions:

1.) To justathought- I do know for a fact that he is my bio-dad. His name is on my birth certificate.

2.) To kat1963- I have tried to contact him. I saw his brother and brother's wife, (my uncle & aunt, they live in NJ) a year or so ago. I asked them to let him know that my mother had died. He responded with "Don't ever talk to anyone in my family, if you want to talk to me you call me directly". Nice guy, huh? The amazing thing is, this was the first time I had ever met my aunt - and she knows sign language. I don't know how or why, and I ddin't ask. But I'm wondering if someone else in his family is deaf too. A genetic thing or something maybe...

3.) To dottkanga- I don't expect him to be responsible for me. I have a good job, own my own home and support myself. I just feel that he should take responsibility for his actions....who knows how many other women he's done this to. My mother never had the boldness to pursue it but I will now that she has passed. And if there are laws that say I can pursue this well, then I will. If not, then I'll go on with my life.

4.) And to you other guys that are so anal about spelling....you really need to lighten up. You have way too much time on your hands. Did you ever think maybe it was just a typo? I'm so sure once in your life you misspelled a word. Jeeze....I wish this forum had spell check, I'm afraid to send this!

Well, thanks again so much everyone. I really appreciate it. You have all been so helpful! :-)
