Colorado: Hi, I'm hoping someone can direct me about whether or not I can pursue this issue in small claims court or not. I loaned a friend $2000 in Nov.2000. It was an oral agreement with open ended payback schedule. I paid her by check. In December of 2004, she begged for an additional $1500 that she promised to pay back within one month. I have email of this request and promise from her. Again, I gave her the loan by check. She had not made any payments to me by April, and I told her she had to pay me back the 1500 within one month and the balance by years end 2005. She did pay $1000 in April 2005. The remainder of the $2500 owed, I know will not be coming. To complicate matters, she filed for bankruptcy last month. I know that she "intends" to pay, but never really will. Do I have any course of action that needs to take place because of Colorado statutes of limitations, or am I out of luck because of the bankruptcy? I appreciate any help in this matter.

Kiss the money goodbye, with the bankruptcy you can never make any attempt to collect on the debt again.
