We live in Virginia and my Wife's youngest sister is having problems with her husband. Back in September my wife's mother passed away with no will. She has always stated that she wanted the house to stay in the family for any of the kids to use if needed. My wife's youngest sister lives their now with her husband. Her husband has been abusing her and telling her if she leaves and divorces him that the family will have to buy his part of the house. So the main question is does he have any rights to the house? His name is not listed on the deed to the house. It is still listed under my mother-in-laws name. Can the other brother and sisters evict the brother-in-law from the house? If we need to get a lawyer, which type of lawyer would we need. Estate or Divorce or what? Approximately how much would it cost us?

The brother-in-law has no rights to the house.

No one is obligated to pay him anything.

I would suggest an attorney specializing in wills and estates.

The guy sounds like an idiot!
