I have been reading up on my Landlord-Tenant laws for the state of Michigan and have a pretty good understanding on my rights to my secuity deposit. I moved out of the rental property 31 days ago. By law he is required to send me an itemized list of damages within 30 days of my termination of occupancy. I still have not received this list. The law also states that if I do not receive this list within 30 days, than he forfeits his right to my security deposit. I still have one month left on my lease and I would like to use my security deposit to pay for this last month. My last month rent is due now. Should I send him a letter now letting him know to use my security deposit since he is in violation of the Michigan act? Or should I wait till he contacts me? I KNOW he thinks he has 30 days from my lease ending, not from me moving out, so he is going to try and send me that list sometime in December. My only convern about contacting him, is that he is going to try and find a way to pre-date the list to look like he was in compliance.

Anybody got any advice?

What you would like and what you " know" is the law does not seem to coincide .

You are under a lease .

If I understood the post correctly you are still in a lease correct? He doesn't have to send you the damage list until your lease has ended.
