My response:
Back in the "olden days" - - that is, pre-1970, you would have been wrong. However, since then, California has changed it's laws and is now a "no fault" divorce State. As such, there are only two grounds for dissolution of marriage:
(1) irreconcilable differences that have caused the irremedial breakdown of the marriage, or
(2) the incurable insanity of one of the parties. [Family Code section 2310]
You'll notice that "adultery" is conspicuously missing. That's because it is no longer a civil or criminal wrong. The laws in California on "adultery" have since been repealed, and most laws along these lines, concerning "affairs of the heart" or, better known in legal circles as the "heartbalm statutes", have also been repealed.
In short, the law doesn't care what you do, as long as it's between two or more consenting adults. California courts no longer get involved in these types of matters.
