I joined up with an online affiliateship with an American Christmas Store in New Jersey which I believed to be of good standing. It began a clickthru payment program a few months later and I followed their acceptable means on obtaining clickthrus as according to an email that was sent out
("quote" You can send traffic any way YOU want,
except Spam E-mail. ALL other traffic, INCLUDING blind links, meta refreshes, redirects, enter buttons and auto consoles, are acceptable. "end of quote")

I had well over 140,000 visitors to my website in two months and by placing an auto console up as per recommended means of obtaining hits I earnt just over $5300US.
Christmas Eve when the hits to a Christmas site are going to drop off suddenly, my stats are changed to a fifth of this amount.
I emailed them for an explantation and they replied to say I must have cheated to receive these hits and they will pay me what they think I should be paid.I replied back to them denying any cheating and asked for them provide proof of such. No reply was received and within two days of this email,my original stats were fully reinstated and the note they put on all affiliates stats pages said in fairness to all from the 1st January 2001 they would no longer pay for clickthrus gained from popups windows etc.

Much relieved I was finally going to get my monies owed,I have now waited two months for payment .I emailed them twice in the past two weeks and received no reply and this morning once again my stats have been changed to a fifth of what I am supposed to be owed. This is after leaving my sales stats at over $5300 for two months! I have received no explanatory email as to why.

What I need to know,do I have a reasonable case against this company and if so who do I contact as I am in Australian and they are in the USA?

I believe I have a case as
1) I followed their email instructions on how to make click thrus hits
2) I did not cheat & they have failed to show me any proof of cheating
3) After I complained,they admitted on their website that in fairness to all, they would stop paying for popups,meta refreshes etc..on the 1/1/01 and then they fully reinstated my stats at the same time. My stats were for July-December 2000.
4) these stats remained the same until today over two months later.
5. I have screenshots of all of this including one from two days ago showing that they owe me over $5300. I have fully documented all this .
6) It seems I am being penalised because I actually followed their instructions and made a large amount of money by these means simply as my site is a high volume traffic site. It is a Christmas website and naturally as such would receive a very big volume of traffic over the months November/December.
7)Most importantly this company acknowledged they noted unusually high traffic from my site way back in November but they did not contact me at all and continued to let me increase my sales stats and send thousands of visitors to their site until d-day(Christmas Eve). I believe they did this to obtain maximum public exposure from my site to their site. Had they been concerned that I was cheating, they should have contacted me immediately back in November asking for an explanation why my stats were so high and not continue to allow the stats increase, and let me to send thousands of people to their company website.
I need advice quick please.

A basic part of doing business is to know who you are doing business with and how solid and honest they are.

Some folks are honest, some are not. Even some honest folks have financial problems, and there are many internet sites going out of business, as you may have been reading, leaving employees, investors, suppliers, customers and others holding the bag.

That's what seems to have happened here. Keep making demands as often the squeaky wheel gets oiled, if there is any oil left. But it's often hard to hear squeaks coming from 8,000 miles away....
