What is the name of your state? Florida
My mother-in-law has managed to develop a rather large credit card debt. Her husband died a few years ago and he had her spending under control while he was alive. Now it is out of control and she is in arrears. She is 85. Her method of coping with his death was to spend money she did not have. What happens to that debt on her death? My husband is her only child. Does he inherit the debt or does it go away on her demise?

No, her son does NOT inherit her debt.

Does she have a home ?

Debts of the deceased are paid out of their estate thru probate. If they have no estate or the estate is insolvent, then creditors get nothing. If her estate is probated, then creditors have a period of time in which they can make a claim against it.

If she leaves no assets, then you send her creditors a copy of the death certificate and tell them there is no estate.

Some of them may try to get her son to pay up, but he is not liable in any way.
