What is the name of your state?Oklahoma I have three children. My oldest is in special education and will be 19 when she graduates. My order states he will pay child support until age 18 or until she graduates. His child support is garnished due to prior problems. Is it his job, prior to or after she graduates to amend child support?

Will she be able to be a self-sustaining adult? If not, then consult an attorney because he may, under state law, be required to continue to provide support. In any case, yes, its up to him to petition to modify child support. Since you have three children it won't go down a great deal...and if his income has significantly increased since the order was last modified it may stay the same or even go up.

Yes, it is his job to amend the order. And how much it will go down (or up) will depend. If the order is written as specific sums for each child, his support will go down accordingly, however, there are not very many orders written this way.

I am not sure how substainable she will be ans an adult. I am trying to get social security disability for her. That's fun enough LOL Where or how can I find out if there is any state laws about child support and special education students? Any ideas?

You can get numerous referals for disabled students including assistance in getting your special needs student qualified for Social Security and into programs, housing and sheltered workshops etc. If your settlement agreement did not cover that already it may be too late or you may have to file for modification, or it may have to wait until your child is qualified.
