What is the name of your state (only U.S. law)? nj
hello, I hope anyone can help me here.
this question is concerning alimony, I already gave my ex half of my 401k, half of the value of the house and no child support since we will both shared custody.
the mediator used my gross income for 2015 which came to $102,000, (we started mediation back in nov. 2016), my ex had started working full time in july 2016 with a gross of $4000 a month so this # was multiplied by 12 to determine her year gross income, $48,000.
the formula that was used was: 102 - 48 = 54 / 3 = 18 / 12 = $1500 a month for 7 years since we were married for 15 years.
since I cannot afford $1500 a month I offered her $1100 a month but for 10 years instead of 7.
here comes my question.
should mediator have used my gross minus my basic tax deductions? federal, state and medicare...which would bring me down to about $85,000?
and same for her but since she is in a different tax bracket her total taxes would be about 15% so she would be down to about $41,000.
my divorce should be granted 10 days from now, if anyone here agrees that incorrect amounts were used against me then I guess I will have to file a motion.
thanks in advanced.
