My wife and I are divorcing. Come to find out she has been sleeping with other men. We are now just in the beginning. The vehicles are all in her name. One of which is totally paid off due to a loan we both signed. She says she doesn't want the house. Will she be responsible for half of our loans since she also signed for them? Also she is working full time and she is living with her boyfriend. We are just in the beginning of a divorce. She has been spending a great deal of money from her credit cards on this guy. Will I be responsible in paying alimony as she is now pursuing that. She is working and she is the one who was unfaithful. We were married for 5 years and no children. Thanks Frank

Your marriage is pretty short for alimony although child support would be a factor, usually determined by standard state formulas. I am not a lawyer and Florida law might also be different, but, in my own circumstances, the fact of adultery by my spouse was not the important factor in itself, it was rather or not the adultery changed the basis of support. That is, is she getting money from this guy or guys? I would suggest you at least get a free consultation from some lawyers, and then, see if she will just go with you to a certified mediator (ie: a respected attorney mediator). We went to a mediator and it saved an enormous amount of money. The agreement has things she wants and things I want, so it was pretty balanced although I don't like paying alimony (we were married 15 years though with a big difference in incomes so no choice under the laws here even though she is an adulteress). On the property, here in Florida it doesn't matter whose names are on it, it's all equitable distribution, and 50-50 at divorce. I suggest also you get your name off those credit cards, cancel them if you can or see what a lawyer recommends. If you have any joint bank accounts, send a letter to the bank and tell them no withdrawls allowed unless you both consent. Good luck.
