What is the name of your state? KY
Lived with him for 13 years, married 10 yrs as of 6/20/02. 2 children ages 11 & 9. Physically & mentally abused for all 13 yrs (no flames please), nervous breakdown in 97, diagnosed with depression, ADHD, & panic/anxiety. Awarded $646 in SS Disability per mo. in 97. This is when I stopped working. "He" went to the drug store at midnight on 8/14/02 and did not return. Have received one $200 ck from him on 9/19/02. He has continued to pay house pmt., electric & car insurance for us (all pmts late). He moved in immediately with a woman & her 2 children. No contact from him except for 3 phone calls for 7 min. total on his cell phone for first 16 days of his abandonment.

This may not be realistic, but it is my opinion & wish: keep the house (he pays for it), get enough alimony to pay all utilities & buy food for all 3 of us, he pays for health insurance for all 3 of us (His employer pays all premiums so this is not an expense to him) for the rest of my life or until I remarry. (We bought the house in 98 after my legal disability)

Isn't there a law against abandoning not only his children but also a mentally disabled person?
What do you think my chances of the judge approving some or all of these requests?

Until the judge rules, you never know, but I think you are justified in seeking alimony as well as child support and definitely for insurance since you probably are not insurable on your own.
Are you receiving a SSD check for each of your children under the age of 18? If not, you need to apply for those benefits and they should be retroactive to the date your benefits began.

I already rcv SSD for the kids. None of the abuse issues were ever mentioned. Just rtnd from court. Still not sure what I got. I finally will rcv. child support of 210 per wk. Also 90 per wk for 'something', lawyer said not to call it alimony or support because the court has not labeled it yet. Also, he's supposed to pay half the mtg. pmt. keep insurance on house & my car. Not sure what if anything else was established. Most of the haggling was done between the lawyers and just when I thought I understood, his lawyer says an amt. of $300 per mo. for his "Half" of the house pmt. ($925)! My lawyer is supposed to contact me to explain, that somehow we came out all right, but I'm just not sure what happened. Oh, the judge also gave him visitation on Tue & Thur. for 2 hours each day in addition to his every other w/e. It's only been 3 mos. & the kids are already tired of being shuffled. What a pain!
