Writing from Ne York State. After being a stay-at-home mom for 12 years for my 3 children, I was divorced in 1998. I was considered the primary custodial parent and my ex-husband paid child support. Rather than pay alimony, he agreed in the divorce agreement to pay 1/2 of costs for academic courses taken in which a grade of B or beeter is obtained. In June, 2000 I remarried and moved in with my new husband, in a different school district than my children attend. The children wanted to remain in the same school district, so my ex-husband now sought to be, and now is, the primary custodial parent, although we still have joint custody. He was then relieved from having to pay child support, but chose not to seek child support from me.
At that time, I quit work(secretary) to pursue a lifelong ambition of becoming a hairdressor. I enrolled in a full time 7 month long cosmetology program and am not working.
Recently, I notified my ex-husband that he had to pay 1/2 of these expenses for my schooling as per the agreement. He refused and so we took him to small claims court where he was ordered to pay. Now, to be vindictive, he is taking me to family court seeking child support and also seeking to have our divorce agreement altered to remove the section relating to his responsiblity for cost of my education.
Question: What will family court consider relating to his request to remove this section of the divorce agreement? Just because the custody and support arrangement has changed doesn't change the fact that I was unemployed for 12 years while raising our children and now am trying to better myself by going to school. Please provide some advice or give your opinion. Thanks, kjudge
