Married, divorced and live in Ohio. My ex wife filed a false financial affidavit with her divorce filing. This resulted in an extreme temporary support order. My attorney, at the time, filed for an emergency hearing on the issue. Also suggested I offer something as support in lieu of the hearing. They accepted. At the final hearing, my income status was not really known because I had recently started my own business because I was laid off. My attorney at the time suggested I continue the amount of support with a provision that our incomes are reviewed the following year. The attorney did not want the court to decide the alimony, said I would get hurt. In the two years since the divorce my ex-wifes income has tripled while mine is about half of what it was. There have been three hearings none of the decisions mention the income. Ex-wifes attorney is good at getting the judge to only look at my expenses. I have reduced my expenses subtantially, had to income was reduced. The latest ruling the judge stated in her decision that the amount of support is based on the affidavits. My ex-wife even admitted they are false (not in court) said she just wrote what her attorney told her to.
I no longer have funds for attorneys. Every month I have to decide between being in contempt or not paying creditors. Our incomes right now are within 3,000 of each other. What recourse do I have? One lawyer said everyone lies in divorce court, but he wouldn't let me lie. This false affidavit has hurt me substantally and it seems I should be able to do something.
